Sixth Degree – Terms and Conditions

These Terms and Conditions (“Terms”) govern access to and use of the Sixth Degree platform, including all websites, applications, dashboards, APIs, and related services (the “Platform”).
By accessing or using the Platform, you agree to these Terms.
1. Platform Role and Scope
Sixth Degree is a technology platform designed to facilitate discovery, communication, and workflow support between professionals and organisations operating within the film and television industry.
Sixth Degree:
Does not act as an agent, employer, broker, producer, or representative
Does not negotiate, approve, or contract on behalf of Users
Does not control productions, bookings, or commercial arrangements
All commercial, creative, and operational decisions remain the responsibility of Users.
2. User Types
The Platform may be used by:
Crew members
Suppliers
Location owners or authorised representatives
Production companies and production teams
Administrators acting on behalf of organisations
Each User warrants that they have the authority to act in the capacity represented.
3. Account Security and Access Control (TPN Requirement)
Users are responsible for:
Maintaining confidentiality of login credentials
Restricting account access to authorised individuals only
Immediately notifying Sixth Degree of suspected unauthorised access
Sixth Degree:
Implements reasonable technical and organisational security measures
Uses role-based access controls where applicable
Does not share account credentials internally except on a strictly need-to-know basis
Sixth Degree is not responsible for breaches resulting from User credential misuse or internal User access failures.
4. Confidential Information and NDAs (TPN Requirement)
4.1 Confidentiality Obligations
Users may be exposed to confidential, sensitive, or embargoed information, including but not limited to:
Production details
Crew attachments
Locations
Schedules
Scripts or creative materials
Commercial terms
Users agree to:
Treat all non-public information as confidential
Use such information solely for legitimate industry purposes
Not disclose information to unauthorised third parties
4.2 Non-Disclosure Agreements
Where a User and Sixth Degree are bound by a Non-Disclosure Agreement (“NDA”):
The NDA shall take precedence over these Terms in respect of confidentiality
Sixth Degree shall not use or disclose covered information beyond the NDA scope
No promotional or marketing use will occur during the NDA term
5. Content Ownership and Intellectual Property
5.1 User Ownership
All Content uploaded to the Platform remains the exclusive property of the User.
Sixth Degree:
Claims no ownership or proprietary rights
Does not license, sell, or sublicense User Content
Does not act as a rights holder or content agent
This applies to all media, metadata, text, images, video, and communications.
5.2 Platform Licence (Operational Only)
Users grant Sixth Degree a limited, non-exclusive, royalty-free licence to:
Host, store, display, and transmit Content
Operate, maintain, secure, and improve the Platform
This licence:
Is strictly limited to platform operation
Does not survive Content removal except where legally required
Does not permit resale or redistribution
6. Promotional Use After NDA Expiry (Clarified)
Upon expiry or termination of an NDA, Sixth Degree may reference:
Names, logos, stills, photographs, or listings of Crew, Suppliers, Locations, or Productions
Permitted use is limited to:
Marketing
Case studies
Platform demonstrations
Industry promotion
Such use shall:
Never disclose confidential or embargoed information
Never imply endorsement without written consent
Reflect publicly visible or industry-standard representations only
Users may opt out of post-NDA promotional use by written notice.
7. Data Protection and Security (TPN Requirement)
Sixth Degree:
Implements reasonable security controls aligned with industry best practice
Restricts staff access to data based on operational necessity
Uses secure hosting and infrastructure providers
Users acknowledge that:
Sixth Degree is a data processor, not a controller, for most Content
Users remain responsible for the legality and appropriateness of shared data
No platform is immune from risk, and no absolute security guarantee is provided
8. Audit, Compliance, and Studio Requirements (TPN Requirement)
Sixth Degree:
Cooperates with reasonable security or compliance enquiries
May provide platform-level security documentation where required
Does not permit studio audits of User accounts or third-party data
Users remain responsible for:
Their own internal security compliance
Ensuring their teams meet studio or broadcaster requirements
9. No Asset Control or Custodianship
Sixth Degree:
Does not own, control, or manage physical locations
Does not store or control original production assets
Does not retain master files, scripts, or rushes
All assets remain under User custody at all times.
10. Accuracy and Responsibility
Users are solely responsible for:
Accuracy of listings and profiles
Rights and permissions for uploaded material
Ensuring listings comply with contractual and legal obligations
Sixth Degree does not verify ownership, clearance, or suitability.
11. Payments and Commercial Terms
Where applicable:
Fees are payable as displayed at the time of purchase
Listings may be suspended for non-payment
No refunds except where required by law
Pricing may change with reasonable notice.
12. Acceptable Use
Users must not:
Upload unlawful or infringing material
Circumvent platform security
Scrape, export, or misuse data
Use the Platform to bypass agents, unions, or contractual obligations unlawfully
13. Service Availability
Sixth Degree provides the Platform on an “as is” and “as available” basis.
We are not liable for:
Downtime
Third-party outages
Loss caused by reliance on Platform availability
14. Limitation of Liability (TPN-Aligned)
To the maximum extent permitted by law, Sixth Degree shall not be liable for:
Production delays
Commercial losses
Confidential disclosures caused by Users
Third-party misuse of information
15. Indemnity
Users agree to indemnify Sixth Degree against claims arising from:
Their Content
Breach of confidentiality
Misuse of the Platform
Failure to comply with industry security standards
16. Termination
Sixth Degree may suspend or terminate access:
For breach of these Terms
For security or compliance reasons
To comply with legal obligations
Termination does not affect confidentiality obligations.
17. Governing Law
These Terms are governed by the laws of England and Wales.
